Rob Kendall, midday co-host of Kendall and Casey on 93.1 WIBC in Indianapolis, is suing Gabriel Whitley for defamation after he allegedly called the radio host a pedophile on social media.
Whitley, a conservative, is running for mayor of Evansville, Indiana.
The Evansville Courier & Press has obtained a screenshot from an August 31st social media post from the Kendall & Casey Facebook page that appears to show a comment from Young Conservatives of Southern Indiana saying “And Rob Kendall hates police too! Pedo Joe and Pedo Rob think alike”.
The lawsuit labels Whitley as the operator of the Young Conservatives of Southern Indiana, while also naming Spencer McDaniel. According to the Courier & Press, McDaniel posted on Facebook that he was informed of the lawsuit and Whitley had “no part in this” saying the comment was a joke and he takes “full responsibility for the joke”.
When presented with the defamation lawsuit, the Young Conservatives of Southern Indiana page reportedly responded by saying “We are a satire page. Bring it on bitch.” They later argued they are protected under the first amendment.
Kendall’s attorney, Abdul Hakim-Shabazz, said “The Defendants’ statements were defamatory per se because they imputed criminal conduct and misconduct on the part of the Plaintiff,” in the lawsuit.
