Newsmax asserts that it will succeed in its pending lawsuit with Dominion Voting Systems, as it believes there are different facts in its case that will enable it to prevail in court. Newsmax cites significant differences between its coverage and that of Fox News regarding Dominion, highlighting its prompt efforts to clarify its reporting and its attempts to have Dominion representatives on the network.
In an article by Marisa Herman, the network also notes that it reached out to Dominion, which declined offers to appear online. Furthermore, Newsmax stands by its coverage and analysis of the 2020 election and vows to defend Dominion’s claim vigorously.
Although Dominion cites more than 3,600 communications it purportedly sent to Fox News, correcting allegations, and asking it to clarify its reporting, which were largely ignored, Dominion sent only a handful of contacts to a single Newsmax employee, which it has yet to produce to date. Newsmax believes it acted reasonably and well within the First Amendment to provide Americans with facts and opinions that helped them make an informed opinion about the 2020 election results.
Herman wrote that Jim Rutenberg, a media critic at the New York Times, discussed the repercussions of Dominion’s case and potential targets for litigation with MSNBC’s Joe Scarborough.
Rutenberg suggested that Mike Lindell and Newsmax could be in Dominion’s crosshairs for future lawsuits. He doubted Newsmax could withstand the legal battle like Rupert Murdoch’s media empire did, citing financial constraints. However, Scarborough pointed out the significant differences between Fox News and Newsmax’s coverage, such as an anchor at Newsmax walking off-set when Mike Lindell began spreading falsehoods.
In Scarborough’s account, he referred to an incident on February 2, 2021, where Newsmax anchor Bob Sellers pushed back against Mike Lindell’s claims about Dominion’s software, saying, “Mike, you’re talking about machines. We at Newsmax have not been able to verify any of those kinds of allegations.”
Newsmax said Dominion filed a lawsuit against the network in Delaware state court in August 2021, and the case is ongoing.
