After a story published by Business Insider last November made accusations that Barstool Sports founder Dave Portnoy had acted violently during sexual encounters with several young women, Portnoy filed a defamation lawsuit against the publication now known simply as Insider. A Federal judge today dismissed the case.
Insider Legal Correspondent Jacob Shamsian tweeted documents pertaining to the trial and it’s dismissal in a Twitter thread Monday.
“Plaintiff cannot seek to establish actual malice by challenging statements that defendants did not publish,” the judge ruled. “And as plaintiff himself concedes, Insider’s articles do not expressly accuse him of criminal sex assault.”
