Judge Rules Dominion Cannot Use January 6 in Fox News Lawsuit

According to Mediate, on Tuesday, a judge ruled in favor of Fox News, stating that Dominion Voting Systems cannot bring up the Jan. 6 Capitol attack during their $1.6 billion defamation lawsuit against the news network.

The lawsuit alleges that Fox News knowingly aired false information about Dominion’s voting machines after the 2020 presidential election amid Donald Trump’s baseless claims of election fraud.

Delaware Superior Court Judge Eric M. Davis previously indicated that he would make this ruling, stating that Jan. 6 was irrelevant to the case. During the hearing, Judge Davis noted that bringing up Jan. 6 would be “too prejudicial” and that the case did not revolve around whether Fox influenced the insurrection. Dominion contends that Fox inspired death threats against their employees, which the judge ruled could be introduced at trial, but not the contents of those threats.

“That may be for another court at another time, but it’s not for this court at this time,” Davis ruled.

Fox News denies all allegations, asserting that this case concerns the First Amendment protections of free speech and a free press. Jury selection begins on Thursday, with high-profile figures such as Tucker Carlson and Sean Hannity slated to testify.
