Right-wing talk show host Larry Elder won a decision in court Wednesday that will allow him to join the California recall election targeting Gov. Gavin Newsom (D).
Elder’s campaign sued the Secretary of State after she excluded him from the list of 41 candidates. Elder allegedly failed to file his tax returns.
“We’ve complied with everything the secretary of state has required of us,” Elder said earlier this week. “The politicians in Sacramento know I’m the only candidate who can beat (Democrat) Gavin Newsom. They are afraid, and they are using whatever shenanigans they can to try to trip me up. It won’t work.”
Judge Laurie Earl ruled that Elder did file the necessary papers on time.
“I am not convinced that Election Code section 8902 applies to recall elections,” said Earl. “I am of the opinion; I am inclined to find that Mr. Elder substantially complied.”
There will be 43 candidates on the September ballot.
