Judge Allows Dominion Voting Systems Suit Against OANN to Proceed

One America News Network had its motion to dismiss the defamation lawsuit brought by voting company Dominion Voting Systems denied as a judge allowed the case to move forward (h/t Forbes). 

Dominion and rival company Smartmatic are pursuing a dozen defamation suits over unfounded election fraud claims regarding their voting machines during the 2020 Presidential Election that saw Joe Biden defeat Donald Trump.

U.S. District Judge Carl Nichols ruled on Monday that Dominion’s lawsuit against OANN can move forward, finding Dominion has jurisdiction to bring the case after the voting company sued OANN in August 2021. 

Dominion alleges that the far-right network fostered fraud allegations despite comprehending they were false and “​​helped create and cultivate an alternate reality where … Dominion engaged in a colossal fraud.”

Meanwhile, Smartmatic separately sued OANN in federal court in November 2021, alleging the network “reported a lie” and spread fraud claims about the company—whose machines were only used in California in 2020—knowing they were false. 

Judge Nichols similarly ruled that the case against OANN can move forward in June.
