Nina Totenberg: Draft Leak Had to Have Come From a Chief Justice

Last week, Politico dropped a bombshell report sharing the draft opinion leak which would overturn Roe v. Wade. While there are many discussing the impact of this possible situation, others also focus on the document being leaked. 

Many are sharing their theory as to who shared the draft with the media, and NPR’s legal affairs correspondent Nina Totenberg offered her thoughts on the matter as there’s now an investigation into the leak.

Totenberg subscribes to the notion that a clerk for a conservative justice is the “leading theory” amid intense speculation as to who is the person that leaked the document. 

“That has never, ever occurred before,” Totenberg said of the leak during her appearance on ABC’s “This Week.”

“That could only, in all likelihood, have come from a justice — that I think is less likely — or perhaps one of the clerks. The only one that makes sense is it came from somebody who was afraid that this majority might not hold.”

In an interview with CNN, Politico’s executive editor, Dafna Linzer, shared whether they’re being contacted as part of the investigation into the leak.

“Honestly, we don’t know more about the investigation than has been made public so far. The [Chief Justice] did not mention publication in his statement, and we don’t see any evidence of a crime here.”
